Today’s judgement from European Court of Justice in Commission v Hungary (C-66/18) related to the Hungarian law amending the 2017 Law on higher education known as “Lex CEU” is a vindication of CEU’s battle to defend academic freedom and the rule of law.

September 25, 2020, Vienna - CEU formally launched its 2020/21 Academic Year on September 25, 2020, welcoming nearly 700 new students from 90 countries to the university. CEU has been notified by Blackbaud, a third-party service provider and one of the world's largest providers of customer relationship management systems for non-profit organizations and the higher education sector, of a data security incident. While Blackbaud assures us that the data compromised in the incident was comparatively low risk as it did not involve credit card information, we immediately launched our own investigation and wanted to inform our community about the situation and the steps we are taking to ensure the greatest possible level of data security.

CEU welcomes the unequivocal opinion of the Advocate General of the European Court of Justice in the matter of lex CEU. Advocate General Kokott has clearly declared that lex CEU violates European law. In her opinion, she declares that Lex CEU “cannot be justified”. It is an exercise of “arbitrary discrimination” and imposes a “disproportionate restriction” on academic freedom. It constitutes a “discriminatory and disproportionate” infringement of the freedom to found and operate educational establishments.
